ORDER ACCEPTANCE POLICY:

Your electronic receipt or other forms of order confirmation do not signify our acceptance of your order, nor do they constitute confirmation of our offer to sell.

Genwyn reserves the right, at any time after receipt of your order, to accept or decline your order for any reason. Genwyn reserves the right, at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $1,500 (USD) may need to obtain pre-approval with an acceptable method of payment, as established by our finance department. We may require additional verification or information before accepting any order.

RETURN POLICY AND 30 DAY LIMITED GUARANTEE:

Every product you buy from Genwyn is backed by our 30-day limited guarantee, described in our Return Policy elsewhere on this site. Genwyn's 30-day limited guarantee provides for either exchange or refund.  Genwyn will assist customers whenever possible in gaining satisfaction with our products.  This is a summary only; you can review our complete Return Policy elsewhere on this site.

REGARDING BUNDLES:

Bundled items are included while supplies last.  Items of the same or greater value may be substituted.

WARRANTY LIMITATIONS:

There are no other express warranties or conditions respecting our products. Implied warranties, if any, are limited to the duration of the express warranty provided herein. In the event your state does not allow limitations on how long an implied warranty lasts, the foregoing limitation may not apply to you.

GENWYN’S PRODUCTS ARE FOR YOUR PERSONAL USE.

The products and services available on the Sites, including any samples Genwyn may provide to you, are for personal use only. You may not sell or resell any of the products or services you purchase or otherwise receive from Genwyn. Genwyn reserves the right, with or without notice, to cancel or reduce the quantity of any order to be filled or products or services to be provided to you where Genwyn, in its sole discretion, believes this may result in a violation of these terms and conditions.

All of the products purchased from the Sites should be used in accordance with the product’s instructions, precautions, and guidelines. The statements made about products on the Sites are for informational purposes and have not been evaluated by the U.S. Food and Drug Administration. The statements and products are not intended to diagnose, treat, cure, or prevent any condition or disease.

WE ENDEAVOR TO FIX INACCURACIES AS WE FIND THEM.

Genwyn shall have the right to refuse or cancel any such orders, whether or not the order has been confirmed and your payment has been confirmed. If your payment has already been confirmed for the purchase and your order is canceled, Genwyn shall immediately credit back the full amount of your payment.

Genwyn may from time to time provide links to other websites (collectively, “Third-Party Websites”) as a service to those interested in this information. Links to Third-Party Websites may also be posted by third parties on Genwyn’s Blog.  If you use any of these links, you will leave the Sites and instead be at the Third-Party Website. Genwyn does not review, monitor, approve, or control content located at Third-Party Websites. The inclusion of any links to Third-Party Websites does not imply Genwyn’s association, relationship, endorsement, or sponsorship of any such Third-Party Website, and Genwyn does not warrant the accuracy or completeness of the content on any Third-Party Website. PLEASE ASK YOUR PARENTS TO PLACE AN ORDER FOR YOU IF YOU ARE UNDER 13.

The Sites are not intended or designed for children under the age of 13.  Children under 13 may look at the Sites but are not permitted to make a purchase, become a registered user, sign-up for emails, or post comments on the Blog.  If we discover that someone under the age of 13 is a registered user or has otherwise provided us with their personal information, we will remove their personally identifiable registration information from our files.  If you are under 13 and would like to make a purchase, please ask a parent or guardian to place the order for you.

PROCESSING TIME:

Please note that credit card processing can take up to 3 business days (sometimes depending on the accuracy of the information entered on our website by the customer.) For security reasons, voice confirmation may be required before we can process your credit card payment.

If the product(s) on your order are in stock, we will ship them as soon as possible. If the item(s) on your order are out of stock, they will not be shipped until we have completed the production of the product(s). You will be notified if we are unable to ship your order within 5 business days.

CREDIT/DEBIT CARD AUTHORIZATIONS:

An authorization on a credit or debit card is a hold against your bank’s credit card spending limit. When the goods are shipped, a charge for the total amount of the order shipped will be sent to your credit card bank. Your bank should release the authorization when the charge is received. A charge is the only time a transfer of funds is completed; an authorization is not a transfer of funds.

RISK OF LOSS:

If the Customer provides Genwyn with the Customer's carrier account number or selects a carrier other than a carrier that regularly ships for Genwyn, title to products and risk of loss or damage during shipment passes from Genwyn to the Customer upon shipment from Genwyn's facility. For all other shipments, title to the products and risk of loss or damage during shipment pass from Genwyn to Customer upon receipt by Customer.

DISCLAIMER:

Genwyn is providing the sites and their contents on an “as-is” basis and makes no representations or warranties of any kind, express or implied, with respect to the operation of the sites, the information, content, materials, or products, included on the sites.  To the fullest extent permitted by law, Genwyn disclaims all such representations and warranties, including for example, warranties of merchantability and fitness for a particular purpose.  In addition, Genwyn does not represent or warrant that the information accessible via the sites is accurate, complete, or current.  ALWAYS USE CAUTION WHEN GIVING OUT ANY PERSONALLY-IDENTIFYING INFORMATION ABOUT YOURSELF OR YOUR CHILDREN.

RELEASE:

By using the Service, you agree to release, discharge, and hold harmless Genwyn and its affiliates (the “Genwyn Entities”) from any and all losses, damages, rights, claims, actions of any kind, and injury (including death) arising out of or relating to the Service or any act or omission by any person, including without limitation, any dispute between you and any other person or regarding any content posted on the Site. If you are a California resident, you waive California Civil Code §1542, which says: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” This release includes, without limitation, any claim resulting from delay and the criminal acts of others.

INDEMNITY:

You agree to indemnify and hold Genwyn and the Genwyn Entities harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of or relating to the Services, including, without limitation, any content posted to or transmitted through the Service, or publicly distributed on the web, your use of the Service, your connection to the Service, your violation of the Terms or your violation of any rights of another.

FRAUD PROTECTION:

We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order, or our customer service department may call you at the phone number you provided to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. We reserve the right to cancel any order using any promotion or promotional code, at our sole discretion. If any order cancellation occurs, you will be credited in full for the canceled order(s). We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.

IN THE EVENT OF ANY PERCEIVED ABUSE(S) OF GENWYN’S SATISFACTION GUARANTEE, TO BE DETERMINED AT THE SOLE DISCRETION OF GENWYN, A RETURN OR MULTIPLE RETURNS MAY NOT BE HONORED.

DISPUTE RESOLUTION:

AGREEMENT TO RESOLVE ALL DISPUTES THROUGH ARBITRATION OR IN SMALL CLAIMS COURT AND AGREEMENT TO WAIVE A RIGHT TO JURY TRIAL AND TO PARTICIPATION IN CLASS ACTIONS

You and Genwyn agree to resolve any controversy, dispute, or claim arising out of or relating to your purchase of any product from Genwyn by binding Arbitration administered by the American Arbitration Association, or in a small claims court, and judgment on the arbitration award rendered by the Arbitrator(s) may be entered in a court having competent jurisdiction. This agreement to arbitrate is intended to be broadly interpreted and covers all controversies, disputes and claims that arise out of or relate to your purchase, including, but not limited to, contract claims, tort claims, statutory claims, or any combination of claims.  We agree that the arbitration or small claim proceeding will take place in the state of California.

APPLICABLE LAW

The Sites are created and controlled by Genwyn in the State of California, U.S.A. As such, the laws of the State of California will govern these disclaimers, terms and conditions, without giving effect to any principles of conflicts of laws.Genwyn reserves the right to make changes to its Sites and these disclaimers, terms, and conditions at any time.  You are responsible for complying with the laws of the jurisdiction from which you are accessing the Sites and you agree that you will not access or use the information on the Sites in violation of such laws. The Sites are not intended to be accessed in any country or jurisdiction in which these terms and conditions, or any other content on the Sites, would violate any laws.
